Dianne M. Smith-Misemer
Dianne has devoted her entire legal career to intellectual property, specializing in trademark and copyright law. Dianne’s years of experience in prosecution, transactional and litigation matters gives her a unique skill set that spans the life cycle of intellectual property from conception and registration through commercialization and enforcement. Based in the Midwest, Dianne’s expertise in trademark and copyright law also translates to efficiency and significant economy for clients who rely on her to protect their company’s most valuable assets.
Dianne regularly advises individuals, small businesses and multinational corporations on brand development and protection strategies and she guides them through domestic and international registration processes. Her hybrid transactional-litigation practice provides clients with the benefit of a single resource for expertise in all trademark matters from the early clearance and application stages and conscientious management of trademark portfolios all the way through dispute resolution and litigation. Dianne’s substantive expertise in trademark and copyright law provides a strong advantage in litigation. She has extensive experience practicing before the United States Patent & Trademark Office’s Trademark Trial and Appeal Board where she has represented clients in numerous opposition, cancellation and concurrent use proceedings. Dianne also represents clients in intellectual property litigation involving trademark and copyright infringement, cybersquatting, false advertising, unfair competition and breach of contract claims.
When clients have business deals that involve their intellectual property assets, Dianne negotiates their license, procurement, development and distribution agreements. She keenly understands and appreciates the interests and concerns from the perspectives of both licensee and licensor. She has negotiated and closed numerous intellectual property deals in the software, financial services, food and beverage, health care, agricultural, education, automotive and telecommunications industries, among many others.
