Jennifer C. Bailey

Jennifer joined Hovey Williams in 2002 and practices in the areas of patent litigation and prosecution. Her experience in all pre-trial phases of patent litigation includes discovery, summary judgment motions, claim construction (Markman) motions, and related hearings. Jennifer’s defense work includes preparing complex requests for reexamination of patents as an optional means for attacking invalid patents. She also is particularly knowledgeable about oppositions of European patents and has participated in opposition proceedings at the European Patent Office in Munich, Germany.

Jennifer’s prosecution experience includes preparing and prosecuting numerous patent applications in the computer software, electrical, and mechanical arts. She also has extensive experience in registering copyrights, including copyrights for software, and advising clients on how best to maintain their copyrights. Jennifer has counseled many clients about infringement, invalidity, and licensing of their patents. In addition, she has negotiated and drafted license agreements, prepared invalidity, non-infringement, and freedom to operate opinions, and negotiated settlements of various types of intellectual property disputes, including inventorship, copyright ownership, patent ownership, and infringement disputes.

Jennifer’s experience in both patent litigation and prosecution benefits her clients, as she is able to apply the tools and lessons learned from both fields. Her broad range of experience allows her to counsel clients on a variety of issues, to minimize expense, to prepare and prosecute patent applications while being cognizant of potential litigation triggers, and to analyze claims and defenses during litigation with the appreciation for the nuances of a patent that comes from having prosecuted patents.

Jennifer is a former adjunct professor of patent law at the University of Missouri-Kansas City School of Law and a former mathematics instructor at the University of Missouri-Columbia. She is also a frequent speaker on intellectual property issues and has been a source for a number of news articles regarding intellectual property. Jennifer serves as an Inn Master in Intellectual Property for the Inns of Court at UMKC School of Law.
