Hovey Williams Obtains Rare Preliminary Injunction for Bushnell Sports Optics and Laser Technology

Hovey Williams LLP is pleased to announce that it has obtained a preliminary injunction in a patent case for Bushnell Sports Optics and Laser Technology Inc.  According to one nationwide study, less than one third of preliminary injunction motions are granted in patent cases.*  Effective December 30, 2009, the injunction prohibits The Brunton Company and Lanshuo Photoelectronic Science and Technology Company from importing and selling certain laser rangefinders that Bushnell and Laser Technology allege infringe patents in litigation pending in the United States District Court in Kansas.  In granting the preliminary injunction, the district court found that Brunton’s and Lanshuo’s products likely infringe multiple claims of two patents and prohibited the continued importation and sale of the accused laser rangefinders pending trial.

Although Chief Judge Vratil of the District of Kansas initially entered the preliminary injunction on November 25, 2009, Brunton and Lanshuo immediately appealed the injunction to the Federal Circuit, which temporarily stayed the injunction during expedited briefing.  On December 30, 2009, the Federal Circuit lifted the temporary stay and denied Brunton’s request to stay the injunction throughout the appeal.  The Federal Circuit’s order is available here.
